Clearhly hosts listings submitted by third parties. Although we require KYB verification before a business can post, KYB does not confirm chain of title. If you believe a listing infringes your rights or misrepresents ownership of a work you control, submit a notice below and we will act promptly.
1. Submitting a takedown notice
File notices through our report form with the category "Copyright". The form collects every element below, so one submission covers both the EU Digital Services Act and the US DMCA. It also goes straight to our Copyright Agent. A valid notice contains:
- The copyrighted work you believe is infringed (title, writers, ISRC or ISWC where available);
- The exact URL(s) of each Clearhly listing you are disputing;
- Your full name, postal address, phone number and email;
- A statement that you have a good-faith belief the use is not authorized by the owner, its agent or the law;
- A statement that the information in the notice is accurate and, under penalty of perjury, that you are the owner, or authorized to act for the owner, of an exclusive right that is allegedly infringed;
- Your physical or electronic signature (on the form: your typed full legal name).
2. What happens next
All periods below run from the day we receive your notice. A notice sent through the report form arrives instantly and is timestamped on arrival, so the clock starts the moment you submit it and you receive a reference number to quote. A notice sent by post starts its clock on delivery; transit time is outside our control and is not counted.
- We confirm receipt in writing within 2 business days for form submissions, and within 5 business days of delivery for postal notices.
- If the notice is complete on its face, we aim to disable the disputed listing within 5 business days of receipt and notify the posting rights holder.
- The posting rights holder may submit a counter-notice. We forward a copy to you and restore the material in not less than 10 and not more than 14 business days unless you tell us that you have filed a court action seeking to restrain the listing owner from the allegedly infringing activity.
- Where a notice is incomplete or we need further information, these periods restart when we receive the missing information.
- We keep an internal audit record of every notice, decision, and appeal.
3. Counter-notice
If your listing was removed after a notice and you believe that was a mistake, file a counter-notice through our counter-notice form. The removal email links to it. A valid counter-notice contains:
- Identification of the removed material and where it appeared before removal;
- A statement, under penalty of perjury, that you have a good-faith belief the material was removed by mistake or misidentification;
- Your name, address and phone number, your consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located or, if your address is outside the United States, any judicial district in which Clearhly may be found, and your agreement to accept service of process from the person who provided the original notice or their agent;
- Your physical or electronic signature.
4. Repeat infringers
We track upheld copyright removals by rights-holder business. After three upheld removals, an administrator reviews the business for termination under our repeat-infringer policy. Termination may occur earlier where the facts warrant.
5. Misuse of the notice process
Filing a materially false notice or counter-notice may create liability under 17 U.S.C. §512(f). Notices are logged and may be shared with the opposing party and, where required, with law enforcement.
6. Disputes that aren't copyright
For non-copyright disputes about a listing (e.g. splits, controlled composition, territorial scope, sample provenance), use the report form (category: Breaks Clearhly's Terms), stating the listing URL and the facts you contest. Each notice is handled manually and given a reference number on arrival. If you already have a clearance request open with the counterparty, raising the point in that request's message thread inside your workspace will normally reach us and them faster. Where warranted, we may facilitate communication with the counterparty and temporarily gate the listing while the parties resolve the issue.
